Councilwoman Barbara Shanklin Files Motion To Delay Trial, County Attorney Says Motion Is Flawed

Embattled Louisville Metro Councilwoman Barbara Shanklin has filed a second complaint in circuit court and is now seeking to delay her removal hearing next month.

The Metro Ethics Commission said Shanklin violated several provisions of the city’s ethics code.  The commission found, among other things, that Shanklin used her position on the council to allocate public funds to a neighborhood organization she oversaw.Shanklin attorney Aubrey Williams is appealing the commission’s findings in circuit court and says the Metro Council Court should wait until after the appeal before moving ahead with the removal trial.In March, five council members petitioned to removal Shanklin from her post, which is scheduled to begin July 23.Jefferson County Attorney Mike O’Connell says he’ll present his case Wednesday morning for why the complaint filed by Williams Monday should be dismissed.“The verified complaint and the release that Ms. Shanklin’s attorney seeks against the Louisville Metro Council is defective on its face," he says, adding, “I think they’ve named the wrong party, I think they’ve not alleged anything near sufficient facts to warrant a court to enjoin this legislative body from proceeding."In the complaint filed this week, Williams argues if Shanklin wins her appeal in circuit court but the Council Court decides to remove her from office before then, the appeal would have no effect.Oral arguments for the appeal are scheduled in September, according to documents submitted this week.
