Green Removal Trial Could Still Move Forward

The Metro Council Court will decide Monday whether to continue with the expulsion trial against Louisville Metro Councilwoman Judy Green, D-1, who resigned last week less a day after vowing to fight the misconduct charges.It is the first time an elected official in Metro Government has faced removal, but Green’s attorney plans to a file a motion to dismiss the charges considering her departure from the council.Green’s resignation does not take effect until the next council meeting, however, and the court still could continue the removal proceedings. The county attorney has argued state law allows for the removal proceedings to go forward, but Green’s attorney says the charges should be dismissed considering her resignation.Court spokesman Steve Haag says lawmakers are committed to making a clear and transparent decision."Councilwoman Green is still a member of the Metro Council until the next council meeting. And so her participation is preferred as is the participation of her legal counsel. With that said, if Councilwoman Green is not there the council court does have the right to be able to move forward,” he says.The council court will decide whether the trial will continue by a majority vote at a 12:30 p.m. meeting in City Hall.
