Indiana Secretary of State Appeals Judge's Decision

Embattled Indiana Secretary of State Charlie White is appealing a decision that gives the State Recount Commission the chance to rule in a dispute over his election.Among other charges, White is accused of voter fraud for using his ex-wife's address instead of his own when voting in last year's primary. After White was indicted on the allegations, Democrats sought to have his election declared invalid.A judge ruled earlier this month that while the Democrats' claim may be valid, it should be decided by the State Recount Commission, which had already dismissed similar charges brought before the indictment.White filed an appeal to that decision today. His attorney says the ruling improperly asks the commission to decide an issue that's already the subject of a separate criminal case. Further, he says the decision is beyond the scope of the commission's powers.Additional information from the Associated Press
