No Ruling in Early Release Case

From Kentucky Public Radio's Tony McVeighA Frankfort judge wants more information before issuing any rulings in a lawsuit challenging the early release of Kentucky prison inmates.The Corrections Department argues it’s pure speculation to claim the early release program presents a clear and present danger to the general public. But Assistant Deputy Attorney General Tad Thomas disagrees, and is asking Franklin Circuit Judge Phillip Shepherd to block further releases until evidence in the case can be heard."I think it’s pretty clear to any of the victims of someone who is released early, that there is no speculation about this harm," says Thomas.Attorney General Jack Conway says the early release program, which has set more than one thousand prisoners free, is unconstitutional. Judge Shepherd wants more information before ruling on the request for injunctive relief. A ruling could come early next week.
